License agreement for the user of PubliSender
IMPORTANT – READ CAREFULLY

PubliSender is realized by Halley Sardegna S.r.l.

Agreement. The present agreement and its possible up-to date versions between Halley Sardegna S.r.l. and the user concerns the usage of the software by the user and/or third parties. The user can use PubliSender from any terminal in which PubliSender Software is installed. The usage of the Software PubliSender implies that the user accepts what follows.

Restrictions in force of the jurisdiction: If some Countries legislation forbid the download, or the use of our software for reasons pertaining minor age or because our product is not allowed, we invite the user not to use the software.

License. Halley Sardegna S.r.l. gives at the user a limited, personal, not commercial, not exclusive, not transferable and not hand-over to download license. The user has to install and use the Software PubliSender in the computer fore the exclusive and personal usage of the application proximity marketing named PubliSender.
The user can use the Software PubliSender for professional reasons, in accordance with this agreement conditions. The Software PubliSender is distributed by Halley Sardegna S.r.l.. The Software enables operational transfers of digital contents between appliances that have got Bluetooth communication system. The Software also enables the user's interface and the documentation (online or offline); and also possible programming correction, up-dating, and improvement of the Software itself.

PubliSender can be used as a marketing device of proximity or generically in order to transfer digital contents between fixed stations and mobile devices.

Changes Ban. The user is not allowed to undertake, cause, permit or authorize any alterations of the Software. It is also not permitted: the creation of issue from other works, the translation, the reverse engineering, the de-compiling, the hacking of the software Publisender o part of it.

Software's up-datings. Halley Sardegna S.r.l. can add more capacities and functions to the software; provide corrections, up-datings and programming improvements.

Legitimate aims. The user must follow all the obligations and duties of this agreement as well as comply with the law and follow all the rules of their own Country in relation with the use of this Software; including import/export regulations for softwares.
The user has to use the Software Publisender for legitimate purposes only. Following this point it has to be said that the user CANNOT: (a) Monitor or intercept, damage or alter any communication that is not directed to the user, (b) Use and send any type of spider, virus, worm Trojan-horse, time bomb or codes and instructions aimed to distort, cancel, damage the software Publisender, (c) Send illegal commercials and communications, (d) Show and/or send to other users offensive materials, obscene or indecent that can also be dangerous for underage, (e) Damage computers and IT systems or part of it to third parties.

Indemnify. The user agrees to indemnify, hold harmless and defend Halley Sardegna S.r.l. and its staff in relation to any responsibility and costs; including the Attorney Honorarium (bill) which can be a result from: (a) Violation or non-fulfilment regarding this Agreement, or any other rule and law that is not explicitly exposed in this agreement, (b) Violation of third party rights, (c) Improper use of the Software Publisender, (d) Widespread communication throughout the Software Publisender.

Enduring, Resolution, Up-dating.
Enduring. This agreement will be valid from the date of the first installation of the Software Publisender until its resolution made by Halley Sardegna S.r.l. or made by the user (explanation behind).

Resolution. The user can end this agreement any time with instantaneous result. Halley Sardegna S.r.l. can solve, limit, suspend without any limits this licence and the usage of the Software Publisender on the part of the user with instantaneous result. Halley Sardegna S.r.l. can use this resolution in case that the user violates this agreement not following our policy; the user can find our policy at www.publisender.com In case that an user violates the law, or in case that an user is involved in illegal, immoral and fraudulent activities; Halley Sardegna S.r.l. can decide to suspend and/or cancel the user's licence. Halley Sardegna S.r.l. will notify that by sending an e-mail to the user.

Agreement Resolution. (a) The licence and the rights of using the Software Publisender will stop immediately, (b) The user must stop the usage of the Software Publisender, (c) The user must cancel the Software Publisender from the PC, from all the hard-discs, from the web and/or from other electronic supports and equipments. The user must also destroy all the copies of the Software Publisender.

Halley Sardegna S.r.l. will not be responsible, in any case, for possible damages caused by this Agreement Resolution; nothing will be given by Halley Sardegna S.r.l. to the user.

Up-dating. Halley Sardegna S.r.l. has the right to modify the present Agreement anytime. Halley Sardegna S.r.l. will publish the up-dating in the website www.publisender.com The up-to-date Agreement will become effective in 30 days from its publication or when the user will receive the up-to-date Agreement. The user can also accept the up-to-date Agreement just clicking the related button during the installation procedure.
Accepting the up-to-date Agreement means that the user is accepting all terms and conditions applied in the up-to-date Agreement. If the user will use the Software Publisender after the 30 days advanced notice and did not accept the up-dating, all terms and conditions will be automatically applied. The up-dating Agreement will be available on the website www.publisender.com/eula

Waiver guarantee and limited responsibilities.
Exclusion of guarantee. THE SOFTWARE PUBLISENDER IS SUPPLIED WITHOUT GUARANTY. HALLEY SARDEGNA S.r.l. DOES NOT SUPPLY ANY EXPLICIT, IMPLICIT OR BY LAW GUARANTY.
HALLEY SARDEGNA S.r.l. DOES NOT PROVIDE ANY DECLARATION RELATING TO THE SOFTWARE PUBLISENDER INCLUDED QUALITY GUARANTY, EFFICIENCY, LACK OF VIOLATION, QUALIFICATION USAGE. MOREOVER, HALLEY SARDEGNA S.r.l. DOES NOT AFFIRM OR ENSURE THAT THE SOFTWARE PUBLISENDER WILL ALWAYS BE AVAILABLE, ACCESIBLE, WELL-TIMED, UNINTERRUPTED, GUARANTEED, ACCURATE, COMPLETE, WITHOUT FAULTS AND/OR THAT IT WILL NOT LOSE PART OF THE DATA STORAGE.

Limited Responsibility. IN NO CASE HALLEY SARDEGNA S.r.l. AND ITS LICENCE CONCESSORI OR ITS STAFF WILL BE RESPONSIBLE, IN RELATION TO THE AGREEMENT OR TO THE GUARANTY, FOR ILLEGAL MATTERS (NEGLIGENCE INCLUDED); AND RESPONSABILITY CONCERNING THE PRODUCTS OR ANY OTHER FORM OF RESPONSIBILITY FOR ANY DIRECT, INDIRECT, PECULIAR OR INCIDENTAL DAMAGE (INCLUDED WITH NOT POSSIBLE LIMITATION: DATA-LOSS, LINE BREAK, COMPUTER FAULTS, PECULIAR LOSS) THAT COMES FROM A NOT CORRECT USAGE OF THE SOFTWARE PUBLISENDER; ALSO IN THE CASE IN WHICH HALLEY SARDEGNA S.r.l. OR ITS STAFF HAD BEEN INFORMED ABOUT THE POSSIBILITY OF THESE POSSIBLE DAMAGES.
The user personally should always verify that the use of Publisender does not violate the law of the Country in which the Software is used.

The user assures to have the Copyright rights concerning the contents which are sent through Publisender.

Halley Sardegna S.r.l. does not take charge of any responsibility regarding direct or indirect damages which can be connectable with the use of Publisender.

Limited jurisdiction. Some jurisdiction do not have all the limitations mentioned previously; some limitations or exclusions could not be applicable to the user. In this case, the responsibility will be limited to the law in force.

Whole Agreement. Terms and conditions of this Agreement establish the whole contract between the user and Halley Sardegna S.r.l. regarding the matter of this topic; and all the previous agreements and deals will be replaced in connection with the matter of this topic.

Partial invalidation. In the event that any term or set-up of this contract will be considered not valid, null and void or not applicable entirely or partially, the other agreements of this contract will keep full validity and effectiveness.

No renounce. If Halley Sardegna S.r.l. does not undertake any actions towards violations of the present Conditions of the service, it does not mean that Halley Sardegna S.r.l. will renounce to its right of making respect subsequently.

Relinquishment. The user is not allowed to give this contract up or sign away this contract. Halley Sardegna S.r.l. has the faculty to sign away or sign over this contract to third parties, without notice.
Publisender software cannot be copy and/or distribute and/or sell back to third parties without the authorization given by Halley Sardegna S.r.l.

In order to activate the program version demo, the user should register through a specific web page, and after the payment the user will receive an e-mail with the activation code in it.
